Terms of Service

These Terms of Service (“Terms”) govern your use of PageFork’s services, including our marketing site at pagefork.ai, the application at app.pagefork.ai, and any related products or support (the “Service”). The Service is provided by ZNiTech (“we,” “us,” or “our”). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Eligibility

You must be at least 16 years old (or the age of digital consent in your jurisdiction) to use the Service. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

Accounts and registration

You are responsible for maintaining the security of your account credentials and for all activity under your account. Notify us at support@pagefork.ai of any unauthorized use.

License to use the Service

Subject to these Terms and your payment of applicable fees, we grant you a non-exclusive, non-transferable, revocable license to access and use the Service in accordance with your plan and our documentation. We reserve all rights not expressly granted.

Your content

You retain ownership of content you submit to the Service (“User Content”). You grant us a worldwide, non-exclusive license to host, process, copy, display, and distribute User Content solely to provide, secure, and improve the Service. You represent that you have all rights necessary to grant this license and that your User Content does not violate any third-party rights or applicable law.

AI outputs

The Service may generate text, images, layout, and other materials using artificial intelligence. You are responsible for reviewing outputs before use in production or for regulated purposes. AI can produce errors or inappropriate content. We do not warrant that outputs are accurate, non-infringing, or fit for a particular purpose. Do not use the Service in a way that could cause harm, discrimination, or illegal activity.

Acceptable use

You agree not to:

• Violate any law, third-party right, or our Privacy Policy;
• Attempt to access non-public areas of the Service, other users’ data, or our systems without authorization;
• Introduce malware, probe or stress systems without written permission, or interfere with the Service’s operation;
• Use the Service to build or distribute illegal, fraudulent, hateful, or dangerous content, or to impersonate others;
• Scrape, resell, or redistribute the Service or its outputs in bulk outside permitted use, or use the Service to train competing machine-learning models without our consent;
• Reverse engineer the Service except where such restriction is prohibited by law.

We may suspend or terminate access for violations of this section.

Fees and plans

Paid features are offered as described at checkout. Fees are non-refundable except where required by law or as we specify in writing. We may change pricing with reasonable notice. Taxes may apply. If you fail to pay, we may suspend the Service.

Our intellectual property

The Service, including its software, designs, and branding, is owned by us and our licensors. Except for the rights expressly granted in these Terms, no rights are transferred to you.

Third-party services

The Service may link to or integrate with third parties (e.g. analytics, payments, or AI providers). Your use of those services is subject to their terms and privacy policies.

Disclaimer of warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW.

Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WE AND OUR AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM OR FIFTY U.S. DOLLARS (US$50) IF YOU HAVE NOT HAD A PAYING RELATIONSHIP WITH US. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO PARTS OF THIS SECTION MAY NOT APPLY TO YOU.

Indemnity

You will defend, indemnify, and hold harmless us and our affiliates from and against any claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your User Content, your use of the Service, or your breach of these Terms.

Termination

You may stop using the Service at any time. We may suspend or terminate your access for breach of these Terms, non-payment, or other legitimate reasons with or without notice where allowed by law. Provisions that by their nature should survive (e.g. disclaimers, limitations, indemnity) will survive termination.

Governing law and disputes

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law rules. The courts in Delaware (or, if applicable, federal courts located there) have exclusive jurisdiction over disputes, and you consent to that venue, except that either party may seek injunctive relief in any court of competent jurisdiction.

Changes to the Terms

We may modify these Terms by posting an updated version on this page. If we make material changes, we will provide additional notice as appropriate. Continued use after the effective date constitutes acceptance of the revised Terms.

Miscellaneous

These Terms constitute the entire agreement between you and us regarding the Service and supersede prior agreements on this subject. If a provision is unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
